Subaru Forester 2011: Automatic transmission noise?

Very soon after we purchased a 2011 Subaru Forester X automatic it developed a heavy drone, so you hear every gear change on accelerating. Subaru said it was the transmission and transferred a unit from a new vehicle, but the noise was still there. Subaru claim it's the air induction into motor and refuse to do anymore about it. I'm very disappointed with the vehicle.

I would ask the dealer to demonstrate that it is an induction noise, if necessary by driving other vehicles, which should have the same noise if he is correct.
