Nissan Patrol 2001: Engine failure

I have recently fallen victim to engine failure in my Nissan Patrol 3.0-litre turbo diesel, which although it is a 2001 model it has only traveled 126,342 km. I have owned it since new, it has a full service record including all major services and oil and filter changes every 5000 km, and it has been immaculately maintained and carefully driven. Nissan rejected my initial warranty claim, but they advised me that while the problem wasn't covered under warranty to have the dealer lodge a 'goodwill' claim. But this too was denied on the basis of the age of the vehicle. We all know what a disaster these engines have been, so I then Nissan another letter reiterating and expanding on some of the points I had previously made, and adding further argument supporting justification for a 'goodwill' claim and requesting the matter be reconsidered. Although I have not yet had a response, I am taking the liberty of forwarding you a copy of my two approaches to Nissan Australia in the hope that, should this latter approach not be successful, you might be able to guide me in taking this matter further if you feel that to be appropriate.

Given the history of your car I would hope that Nissan would come to the party with assistance in rebuilding your engine. If there is no offer forthcoming the only course left open to you is legal action and I would consult the fair trading people in your area.
