What's a lemon?

We upgraded to a new Volvo XC90 a few weeks ago. At 1300 km the car is displaying a brake fault and subsequently the engine shuts down. We wait for about five minutes and then it will restart. It does not go into limp mode to get us home. This happened Monday, Wednesday and Friday last week and each time we have taken it back to the dealer. They currently have it now. We have spoken to the dealer principal to ask when does it become deemed a lemon, but he assures us it can be fixed. How many times is reasonable under the Australian consumer laws?

18 Jun 2012There is no definition of a 'lemon' in this country, so you're in the hands of the dealer and the carmaker, at least in the short to medium term, in which they should fix the car as they say they can. If that doesn't prove to be the case take your case to the state consumer affairs people and ask for their help in getting a resolution.
